YLR 2022 953 · Balochistan High Court

This case came from the Balochistan High Court, where two petitioners (levies officials) challenged an order directing police to register a criminal case against them. The dispute arose after a road accident: a passenger van collided with the petitioners' official vehicle. One petitioner said the respondent forcibly stopped their vehicle, got into an argument, and tore a levies official's shirt, after which the respondent was arrested and an FIR was registered against him the same day. The respondent, however, claimed he was forcibly abducted, tortured, and wrongfully confined for ten hours by the petitioners before being handed over to police on a false FIR. He got a lower court (acting as Ex-officio Justice of Peace) to order registration of a criminal case against the petitioners, without giving them a chance to be heard first.

The High Court set aside that order. It found no medical evidence supporting the respondent's torture claims, noted that the FIR against him was lodged and he was arrested the very same day (undermining his wrongful confinement claim), and concluded his application appeared aimed at harassing the public servants rather than seeking genuine justice.

The judgment reaffirms an important principle: a Justice of Peace cannot mechanically order FIR registration just because someone alleges wrongdoing. They must apply judicial mind and ensure there's credible supporting material, since the power under Section 22-A Cr.P.C. is discretionary ("may," not "shall") and meant to prevent misuse of the criminal justice system to harass people.
