Naseebullah and others V. The State through Prosecutor General Balochistan and others ,
YLR 2022 885 · Balochistan High Court
This case involved an appeal before the Balochistan High Court arising from a shooting incident in which the complainant's father was injured and his brother was killed. Two accused were tried: one alleged to have fired the shots, and a co-accused allegedly present with him.
The court examined the delay in filing the police report (just over an hour) and found it was lodged promptly, given that witnesses first rushed the victims to hospital. It also reviewed eyewitness testimony from the complainant, the injured father, and another relative, finding their accounts consistent, credible, and well-corroborated by medical evidence and forensic analysis matching recovered bullet casings to a pistol linked to the main accused.
The court held that being related to the victims did not make witnesses unreliable, since their testimony was independent and truthful. However, regarding the co-accused, the court found the prosecution had only shown he was present at the scene, with no evidence he fired a weapon or shared a common intention to commit the crime. Mere presence alongside the shooter was not enough to establish joint liability under Section 34 of the Penal Code, which requires proof of shared intention, not just similar circumstances.
Consequently, the court upheld the conviction of the main accused but acquitted the co-accused, highlighting the legal principle that criminal liability for common intention requires more than mere association with an offender.
