Malik Muhammad Ameen V. Mst. Saeeda Maqbool and others,

YLR 2022 742 · Balochistan High Court

This case involved a dispute over a house in Quetta. The petitioner claimed he had purchased the house from Maqbool Ahmed, one of several co-sharers who inherited it, through a 2008 agreement where he paid half the price upfront, with the rest and formal transfer due later. He said he continued paying rent to the seller and his widow after his death. When the property was later transferred through inheritance to another relative and then sold to a third party, the petitioner sued for a declaration of ownership, cancellation of the mutation records, and enforcement of the sale agreement.

Both the trial court and the appellate court rejected his claims, finding no credible evidence that the sale agreement was genuine or that any payment was ever made. His own witnesses could not confirm they were present when the agreement was signed or money changed hands. The courts also noted the petitioner kept paying rent for years after supposedly buying the house, undermining his ownership claim. Crucially, one co-sharer could not sell the entire jointly-owned property without the consent of the other co-sharers.

The High Court upheld these findings, explaining that in revision it could not overturn concurrent factual findings of lower courts unless they were clearly illegal, irrational, or unsupported by evidence. It also ruled that a tenant cannot challenge his landlord's title without first giving up possession. The petition was dismissed, reinforcing protections for co-owned property and limits on tenants disputing ownership while still occupying the premises.
