Muhammad Ameen V. The State ,
YLR 2022 694 · Balochistan High Court
This case involved a man, Muhammad Ameen, who was convicted under Pakistan's Control of Narcotic Substances Act, 1997 for possessing 520 grams of charas (hashish). Police claimed they acted on a tip-off, found him in an empty quarter near a railway colony, and recovered the drugs from his possession. He was convicted by a Special Judge in Dhadar and sentenced to one and a half years' rigorous imprisonment plus a fine, with benefit given for time already served. He appealed to the Balochistan High Court.
The High Court examined the prosecution's four witnesses, including the arresting officer and investigators, and found their testimony consistent, credible, and unshaken by cross-examination. The court rejected the defense argument that no independent (private) witnesses were present during the arrest, ruling that the law specifically exempts narcotics cases from the usual requirement of involving private witnesses during searches.
The defense also argued that a four-day delay in sending the seized drugs for chemical testing cast doubt on whether the sample was tampered with. The court held that the relevant testing timelines are only directory, not mandatory, and since there was no evidence of tampering, the delay did not undermine the case. The chemical report confirmed the substance was charas.
Finding no reason to doubt the prosecution's evidence, the court dismissed the appeal and upheld the conviction and sentence. The case clarifies that minor procedural delays and absence of private witnesses do not automatically invalidate narcotics prosecutions in Pakist
