Torab Khan V. Tahir Khan,
YLR 2022 2110 · Balochistan High Court
This case is about a rental dispute decided by the Balochistan High Court. The landlord, Tahir Khan, had filed for the eviction of his tenant, Torab Khan, under the Balochistan Urban Rent Restriction Ordinance, 1959. During the proceedings, the trial court ordered the tenant to deposit Rs. 10,000 as monthly rent before the 5th day of each month until the case was resolved. However, the tenant repeatedly failed to pay on time, sometimes depositing less than required or paying weeks late. Because of this, the landlord asked the trial court to strike off the tenant's defense, and the court did so, ordering the tenant to vacate the shop.
The tenant appealed, but the High Court upheld the trial court's decision. It explained that Section 13(6) of the Ordinance is mandatory, meaning once a tenant is ordered to pay rent by a specific date, he must strictly comply. If he fails to do so, the law requires that his defense be struck off and the landlord be given possession, without further proceedings. Since the tenant had clearly missed deadlines and underpaid in some months, the court found he had violated this rule and dismissed his appeal.
This judgment reinforces that tenants involved in rent disputes must strictly follow court-ordered payment deadlines, as non-compliance can lead to automatic loss of their legal defense and eviction, regardless of other circumstances.
