YLR 2022 1992 · Balochistan High Court

This case is about an appeal filed by the complainant against the acquittal of a man accused of being involved in his brother's murder, which took place in 1995. The main accused in the shooting was separately convicted, and that conviction was upheld all the way up to the Supreme Court. However, the respondent in this appeal was accused only of abetment and sharing common intention with the shooter, not of firing the fatal shots himself.

The trial court acquitted the respondent, finding that no specific role, weapon, or motive had been clearly attributed to him by the complainant or witnesses. Crucially, the only eyewitness to the crime had died before he could testify against this particular respondent, and his earlier statement (given in relation to the main accused) could not be used against the respondent because the respondent never had a chance to cross-examine him.

The Balochistan High Court upheld the acquittal, agreeing that the prosecution failed to prove the respondent's involvement, motive, or common intention beyond doubt. It reaffirmed the important legal principle that an acquittal carries a "double presumption of innocence," meaning appellate courts should only overturn it in cases of serious and obvious error, not simply because another view of the evidence is possible. The appeal against acquittal was therefore dismissed.
