YLR 2022 173 · Balochistan High Court

This case involved a man accused of murdering the son of the complainant, allegedly along with a co-accused, under Pakistan's Penal Code provisions on murder and common intention (sections 302 and 34). There were no eyewitnesses to the killing, making it an unseen occurrence that relied entirely on circumstantial evidence.

The prosecution's case rested mainly on three things: a witness who claimed to have last seen the accused taking the victim away on a motorcycle, physical items like a rope, slipper, and motorcycle recovered based on the accused's statements to police, and the accused's own disclosure made while in custody. The Balochistan High Court found serious problems with all of this evidence. The "last seen" witness only came forward three days after the victim went missing, despite being the complainant's own nephew, making his story appear fabricated and unreliable. The FIR itself was filed four hours after the body was discovered, raising further doubt. The recovered items were not properly sealed by investigators and were commonly available objects, not found in any hidden location, so they didn't qualify as meaningful discoveries. The accused's disclosure to police came 14 days after arrest and wasn't made before a magistrate, reducing its legal weight.

Given these gaps, the court ruled the prosecution failed to build the complete, unbroken chain of evidence required to prove guilt beyond doubt in a circumstantial case. The conviction was overturned and the appeal allowed, reinforcing that weak, delayed, or uncorroborated evidence cannot justify a murder conviction
