Sher Zaman and 2 others V. Syed Abdul Sadiq and 2 others,

YLR 2022 1276 · Balochistan High Court

This case is about a family land dispute in Quetta that had been stuck for years over a technical procedural issue: could the plaintiff amend his original lawsuit, or did he need to withdraw it and start over?

Sher Zaman had filed a civil suit seeking declaration, specific performance of an agreement, possession, and injunction, based on an agreement (iqrarnama) from 2012. His original plaint had drafting problems, including unclear description of the property and an incomplete account of the cause of action. He later asked the trial court to allow amendments to fix these issues. The trial court allowed the amendments, but the District Court reversed that decision, ruling that the changes were so significant they would alter the entire nature and cause of action of the suit, which is not permitted under ordinary amendment rules.

The Balochistan High Court agreed that such fundamental changes could not be made through a simple amendment. However, it held that the defects in the original plaint, poor drafting, missing facts about the agreement, and unclear property description, qualified as formal defects or other sufficient cause under Order XXIII, Rule 2 of the Civil Procedure Code. Since the case was still at an early stage with no evidence recorded, the court ruled that the plaintiff should not be denied justice over technicalities. It allowed him to withdraw the suit and file a fresh, properly drafted one. This shows courts favoring substance over procedural technicality when a genuine claim exists.
