Najeebullah and others V. The State ,

YLR 2022 1222 · Balochistan High Court

This case involved three men arrested together in a vehicle near Pishin, Balochistan, after police stopped the Surf van they were traveling in. Officers recovered five kilograms of hashish from the vehicle's trunk, along with Rs.535,000 in cash. All three were tried together and convicted under the Control of Narcotic Substances Act, 1997, with the driver, Wali Muhammad, and two passengers, Najeebullah and Naseemullah, each sentenced to seven years imprisonment and fines.

On appeal, the Balochistan High Court upheld the driver's conviction, holding that the person driving a vehicle carrying narcotics is responsible for transporting the contraband, and that the prosecution's evidence—consistent witness testimony, proper recovery procedure, and an intact chain of custody for the forensic sample—was credible and unshaken by cross-examination. The court also rejected arguments that the absence of independent civilian witnesses during the search invalidated the case, noting that a specific provision of the narcotics law excludes the usual requirement for private witnesses, and that reluctance of ordinary people to get involved in such cases is a recognized reality.

However, the court overturned the convictions of the two passengers, finding no evidence they knew about the hidden hashish or had any connection to the vehicle beyond merely riding in it. Since the drugs were concealed in the trunk and not visible to them, mere presence was insufficient to prove guilt.

This case highlights the principle that criminal liability in narcotics cases requires proof
