Abdul Nasir and others V. The State and another,
YLR 2022 107 · Balochistan High Court
This case involved two appellants, Abdul Nasir and his wife Mst. Rabia, who were convicted by a trial court in Khuzdar, Balochistan, for murdering the complainant's parents and injuring him by gunfire. They were sentenced to death. Both appealed to the Balochistan High Court, which also reviewed the case through a Murder Reference, a mandatory process for confirming death sentences.
The High Court examined the evidence, including eyewitness testimony from the complainant and his brother, both sons of the deceased, and medical evidence confirming the firearm injuries. The court found their accounts credible, consistent, and unshaken despite cross-examination, and ruled that being related to the victims did not automatically make their testimony unreliable. The court upheld the convictions, finding the prosecution had proved its case.
However, the court identified problems with the prosecution's case regarding sentencing: the recovered weapon was never scientifically matched to the crime, making it unreliable evidence of the sequence of events, and the alleged motive for the killings was never proven or even questioned to the accused during trial. Because of these gaps, the court could not be certain exactly what triggered the killings, making the death penalty inappropriate.
As a result, the High Court maintained the convictions but reduced the sentence from death to life imprisonment. This case illustrates how courts can accept guilt based on strong eyewitness evidence while still showing leniency in sentencing when doubts remain about motive or supporting forensic evidence.
