YLR 2021 Note 61 · Balochistan High Court

This case from the Balochistan High Court (Sibi Bench) involved an appeal against convictions for murder. The accused were charged with shooting and killing the complainant's brother, allegedly motivated by prior threats and an earlier dispute involving the complainant's shop. One accused was also accused of acting in common intention by standing armed nearby while the murder took place.

The defense raised several points to challenge the prosecution's case: a three-hour delay in filing the police report (FIR), alleged discrepancies in witness testimony, and questions about whether witnesses were reliable given their relationship to the deceased. The court rejected these arguments. It found the delay was reasonably explained by the time taken to rush the injured victim to the hospital before reporting the crime. It held that minor inconsistencies in testimony don't undermine a case unless they damage its core elements. It also clarified that being related to a victim doesn't automatically make a witness "interested" or unreliable - what matters is whether they have a motive to falsely implicate someone.

The court found the eyewitness accounts, medical evidence (multiple gunshot wounds matching the ocular testimony), and recovered weapons and cartridges all corroborated each other. It also held that the armed companion who prevented resistance could be held equally liable, not merely as a facilitator, since his presence showed shared criminal intent.

The appeals were dismissed, upholding the convictions. This case is useful for showing how courts evaluate delayed FIRs, witness credibility, and shared criminal responsibility in murder cases.
