Abdul Ghani V. The State,
YLR 2021 Note 108 · Balochistan High Court
This case involved a man convicted of raping a ten-year-old girl while she was out grazing goats with her younger sister. The trial court had found him guilty and sentenced him to ten years in prison. Both the convicted man and the state appealed - he sought acquittal, while the state sought a harsher sentence through a criminal revision.
The Balochistan High Court upheld the conviction, rejecting arguments about a thirteen-hour delay in filing the police report, since the father was out of town and acted promptly once informed. The court relied on strong medical evidence showing recent sexual assault, and on the detailed, consistent testimony of the victim and her younger sister, who were both found competent child witnesses despite their young ages, after the trial judge properly tested their understanding. The court noted that DNA testing is not legally required to prove rape when other evidence is sufficient.
Importantly, the court found that the trial judge had made a legal error: under the law applicable at the time (as amended in 2016), rape of a minor carried only two possible punishments - death or life imprisonment - not a ten-year term. Since the accused was himself a juvenile (16-17 years old) at the time, the death penalty was barred by juvenile justice law, leaving life imprisonment as the only proper sentence.
The court dismissed the man's appeal and enhanced his sentence from ten years to life imprisonment.
