Director General Civil Aviation Authority through Airport Manager, Quetta V. Muhammad Dawood,
YLR 2021 848 · Balochistan High Court
This case involved a dispute between the Civil Aviation Authority (Quetta Airport) and a contractor, Muhammad Dawood, who had been awarded a parking contract for three years starting in 2008. The contractor claimed that the Airport Authority's construction work next to the parking area damaged his business, causing him a loss of Rs. 300,000, and he sued for declaration, an injunction, and damages. The Authority, in turn, claimed the contractor owed it Rs. 193,000 in unpaid license fees and had adjusted his security deposit against this amount.
The trial court dismissed both claims, finding neither side had proven its case, and the Airport Authority's appeal against this decision was also dismissed by the Additional District Judge. The Authority then filed this civil revision petition before the Balochistan High Court.
The High Court upheld the lower courts' decisions. It found that the Authority had never specified or documented how it calculated the Rs. 193,000 it claimed was owed, and had produced no evidence to support this figure. The Court also noted that the Authority's appeal before the lower appellate court had been filed late, and its explanation for the delay (that time was needed to obtain official sanction) was unsupported by any documentation, so the delay could not be excused under the Limitation Act.
Finding no legal error in the concurrent findings of the lower courts, the High Court dismissed the revision petition. The case highlights the importance of providing documentary evidence to support monetary claims and meeting appeal deadlines with properly justified reasons for delay.
