Quetta Development Authority through Director General, Q.D.A V. Sajjad Khan and 10 others ,
YLR 2021 795 · Balochistan High Court
This case involved a land dispute between the Quetta Development Authority (QDA) and a group of landowners whose property had been acquired in 1993 to build the Sraghudgi Housing Scheme. Under the Land Acquisition Act of 1894, an award was made fixing compensation for the land, with QDA promising to pay the remaining balance within six months. When QDA failed to pay the outstanding amount, the landowners sued for the unpaid compensation plus 15 percent additional charges as allowed under the law.
The trial court ruled in favor of the landowners, and QDA appealed. The case eventually went to the Supreme Court, which sent it back to the Balochistan High Court for a decision on the merits.
The High Court rejected QDA's argument that the lawsuit was filed too late, finding it was filed within the three-year legal deadline since the clock started when QDA failed to pay after the six-month grace period. The court also examined whether QDA had actually taken possession of the land, hearing testimony that QDA officials had indeed taken over the property and even held a public inauguration ceremony for the housing scheme.
Ultimately, the High Court upheld the landowners' right to compensation, but recalculated the 15 percent additional compensation to run specifically from the date of the award (March 1993) until the date the outstanding amount was actually paid (February 2001). The appeal was dismissed, meaning QDA had to honor its payment obligations to the original landowners, with interest calculated for the full delay period.
