Muhammad Sultan V. The State,
YLR 2021 690 · Balochistan High Court
This case involves Muhammad Sultan, who was arrested after police found 4000 grams of charas (hashish) in a vehicle he was driving, along with two other passengers. He was charged under the Control of Narcotic Substances Act, 1997, for transporting narcotics.
Sultan had already applied for bail once, and the Balochistan High Court rejected that application on its merits, finding that as the driver of the vehicle, he could not escape liability at that stage of the case. About a month and twenty days later, he filed a second bail application before the same court, essentially repeating his request.
The court dismissed this second application, holding that a repeat bail application can only be filed if there is a genuinely new ground that did not exist when the first application was decided. Since Sultan's lawyer could not point to any fresh ground, and all his previous arguments had already been considered and rejected on merits, the second application was deemed meritless and not maintainable. The court relied on a Supreme Court precedent (State v. Zubair, PLD 1986 SC 173) which clarified that judges need not address every argument separately in detail, and that a prior rejection on merits covers all grounds raised, barring repeat applications without new grounds.
This case matters because it reinforces an important procedural rule: courts will not allow litigants to repeatedly seek bail on the same grounds already rejected, preventing misuse of the judicial process.
