Wazir Muhammad V. The State,

YLR 2021 611 · Balochistan High Court

This case concerns Wazir Muhammad, who was convicted by a trial court in Killa Abdullah, Balochistan, for the murder of his wife, Mst. Bibi Gul Dasta, who was killed inside their home. He was sentenced to life imprisonment and fined under section 302(b) of the Pakistan Penal Code.

The prosecution's case rested on an FIR lodged by the complainant, the victim's brother, who was not an eyewitness and did not explain how he knew the appellant was responsible. Two other witnesses, the couple's sons, also had not seen the crime themselves; they only repeated information told to them by their uncle, who was never produced or examined in court. The prosecution argued that since the wife died unnaturally inside the husband's house, some burden fell on him to explain her death, and his absconding after the incident suggested guilt.

The Balochistan High Court disagreed. It held that hearsay testimony from witnesses who didn't witness the crime cannot reliably identify the real culprit. While the husband's failure to explain his wife's death inside their home was suspicious, this alone did not amount to the level of proof required for a murder conviction. The court also ruled that mere absconding is not proof of guilt, since people flee for many reasons. Finding the prosecution failed to prove guilt beyond reasonable doubt, the court acquitted the appellant, extending him the benefit of the doubt and overturning his conviction and sentence.
