Nasar Ud Din V. The State,

YLR 2021 457 · Balochistan High Court

This case involved a man named Nasar Ud Din who was stopped while driving a vehicle, which police allegedly searched and found 67 packets of charas (a narcotic drug) weighing 80 kilograms hidden in secret compartments. He was convicted under Pakistan's narcotics law and sentenced to life imprisonment plus a fine by a trial court.

On appeal, the Balochistan High Court overturned the conviction, finding serious flaws in how the prosecution built its case. Instead of testing a sample from each of the 67 packets separately, authorities combined everything into one 670-gram sample and tested only that, which the court said violated established legal requirements, citing prior Supreme Court rulings that each packet must be sampled and tested individually. The laboratory report also failed to properly document the technical protocol behind its chemical testing, making it legally insufficient to prove the substance was actually charas. Additionally, the prosecution could not prove the recovered material had been safely stored and transported to the lab without tampering, and failed to produce a key witness (the police record-keeper) to establish this chain of custody. Most strikingly, the witness who claimed to have found the drugs in secret compartments of the vehicle admitted during cross-examination that no such hidden compartments actually existed.

Given these failures, the court ruled the prosecution had not proven its case beyond reasonable doubt and acquitted the appellant, highlighting how procedural shortcuts in narcotics cases can undermine convictions.
