Deputy Commissioner (Revenue)/Collector, Quetta and another V. begum jamila daud and 15 others,

YLR 2021 283 · Balochistan High Court

This case was about a dispute over how much compensation the government should pay to landowners whose property was taken to widen a road in Quetta (connecting Mastung Road/Arbab Karam Khan Road to Hazar Ganji). The Land Acquisition Collector had awarded compensation based on an average land price calculated over just one year before the acquisition notice. The landowners felt this was too low and challenged it in a reference before the Additional District Judge, who increased the compensation significantly, setting higher rates for commercial land, residential land, and construction costs, plus statutory additions for compulsory acquisition and delayed payment.

The government appealed this increased award to the Balochistan High Court, arguing the original, lower valuation was correct.

The High Court dismissed the appeal and upheld the increased compensation. It ruled that using a simple one-year average price is not an adequate or absolute method for valuing acquired land, especially given rising property prices. Citing a Supreme Court precedent, the court held that landowners who sacrifice their property for public projects must be compensated fairly and realistically, considering the land's location, potential, and market value, not through a mechanical formula. Since the acquired land was prime, well-located property, the court found the trial court's enhanced compensation reasonable, not excessive.

This judgment matters because it reinforces that compensation for government land acquisition must reflect true market value and fairness to citizens, not just bureaucratic averages.
