Saleh Muhammad V. Executive Engineer Irrigation and 5 others,

YLR 2021 2425 · Balochistan High Court

This case involved a dispute over a piece of land in Quetta. The petitioner, Saleh Muhammad, claimed he had purchased the property from its previous owner, Rasool Bakhsh, and was living on it. He filed a lawsuit asking the court to declare his ownership and to issue a permanent injunction stopping the Irrigation Department and other officials from interfering with his property. Along with the suit, he asked for a temporary injunction to maintain the status quo while the case was being decided.

The Irrigation Department opposed this, arguing that the land had actually been acquired by the government back in 1991 for use as a flood/rain drainage channel, and that compensation had been paid to the original owners at that time, even though the acquisition was never formally updated in the official revenue records.

Both the trial court and the appellate court refused to grant the temporary injunction, and the petitioner then approached the Balochistan High Court. The High Court upheld these decisions. It explained that simply having an arguable case is not enough to get an injunction; courts must also weigh whether the balance of convenience and risk of irreparable harm favor the person seeking it. Since government records showed the land had already been acquired and paid for, the court found the petitioner failed to establish a strong enough case or convenience in his favor, and dismissed his petition.
