Najeebullah V. The State through Prosecutor General, Balochistan,

YLR 2021 2182 · Balochistan High Court

This case is about Najeebullah, who was convicted by a Sessions Court in Loralai for the murder of Mehmood Shah, based on allegations that he and others attacked the deceased, who fled into a shop, and was fatally shot there. He was sentenced to life imprisonment under Pakistan's murder law along with the concept of common intention.

On appeal, the Balochistan High Court overturned the conviction. The court found several serious problems with the prosecution's evidence. First, the FIR was lodged 23 hours after the incident with no explanation for the delay, raising suspicion of deliberation or manipulation. Second, while the original police report named Najeebullah as present, it assigned him no specific role in the killing; later, the complainant improved his statement to claim Najeebullah had held down the victim, a significant and unexplained shift that the court viewed as dishonest and unreliable. Third, key witnesses who could have supported the prosecution's account, such as the shopkeeper and the man who transported the deceased to hospital, were never examined, suggesting their testimony may not have helped the prosecution. Finally, the witnesses who did testify were closely related to the deceased and were "chance witnesses" without solid grounding for being present.

Given these doubts, the court ruled the prosecution failed to prove guilt beyond reasonable doubt and acquitted Najeebullah, highlighting how delayed reporting, contradictory statements, and withheld evidence can undermine a criminal conviction.
