Abdul Khaliq V. Sher Ali and 3 others,
YLR 2021 1619 · Balochistan High Court
This case concerns a criminal appeal in Balochistan arising from a dispute between the complainant, Abdul Khaliq, and four accused persons. The complainant alleged that during a civil dispute, the accused attacked him and his companion, Bashir Ahmed, causing injuries. A trial court acquitted three of the accused, finding contradictions between witness statements and medical evidence, and Abdul Khaliq appealed against this acquittal.
The High Court dismissed the appeal outright. It found two major problems. First, the evidence itself was weak and contradictory: the injured witness claimed fractured hands, but the medical certificate did not record this; and the complainant claimed he suffered deep injuries, but the doctor testified she found no injuries on his body at all. Second, and more importantly, the court ruled that Abdul Khaliq had no legal right to bring this appeal in the first place. Under the law, only a "person aggrieved" can appeal an acquittal in injury cases, and this must be the actual injured victim (unless that person is a minor or insane). Since Abdul Khaliq himself was not injured, he could not file the appeal — only Bashir Ahmed, the injured party, could have done so, and he chose not to.
The judgment reinforces an important principle: acquittals carry a "double presumption of innocence" and should not be overturned unless clearly unjust, and only the actual aggrieved victim has standing to challenge such acquittals in hurt cases.
