Khushhal V. The State,

YLR 2021 1579 · Balochistan High Court

This case involved an appeal against a murder conviction. The prosecution alleged that the appellant, along with several co-accused, tried to steal two bullocks from the complainant's home at night. When the complainant tried to catch them, the accused allegedly opened fire, fatally wounding the complainant's brother. The trial court convicted the appellant under section 302(b) of the Pakistan Penal Code, sentencing him to life imprisonment and a fine.

On appeal, the Balochistan High Court overturned the conviction, finding the prosecution's case riddled with doubt. Key problems included an unexplained eight-hour delay in filing the police report, raising suspicion of fabrication; the complainant being the only eyewitness, while other claimed witnesses were never produced in court; and a stark contradiction between the ocular account and medical evidence, since the postmortem was conducted eleven hours after death despite the incident happening at 1:30 a.m. The court also noted the implausibility of identifying attackers in darkness, since no light source (like an electric bulb) was ever recovered as evidence, despite claims of available lighting.

The court reaffirmed the principle that any reasonable doubt in a criminal case must benefit the accused as a matter of right, not leniency, and that circumstantial factors like absconding cannot substitute for solid direct evidence. Given these serious inconsistencies, the court acquitted the appellant, allowing the appeal.
