Muhammad Shafiq V. The State ,
YLR 2021 1410 · Balochistan High Court
Muhammad Shafiq was convicted by a trial court in Killa Saifullah for murdering Gul Shah Khan, who was shot while walking toward the National Highway with his son. The trial court sentenced him to death under section 302(b) of the Pakistan Penal Code. He appealed to the Balochistan High Court, and the case also came before the court as a murder reference for confirmation of the death sentence.
The High Court examined the evidence carefully. The complainant had promptly named the accused in the FIR, and two witnesses, including the deceased's son, gave consistent, truthful, and unshaken accounts of the shooting despite lengthy cross-examination. Their testimony was supported by medical evidence and the recovery of the victim's blood-stained clothes. The court noted that although a pistol was recovered from the accused, it was not sent for forensic testing against the bullet casings found at the scene, so this recovery did not help the prosecution. The court also found no proven motive, but ruled that absence of motive alone does not create doubt when direct eyewitness evidence is strong.
However, considering the lack of established motive and the overall circumstances, the court held that the death penalty was not appropriate. It upheld the conviction but reduced the sentence to life imprisonment. This case illustrates how appellate courts in Pakistan can reassess sentencing even while confirming guilt, particularly when circumstances surrounding motive remain unclear.
