YLR 2021 1109 · Balochistan High Court

This case from the Balochistan High Court concerned three men convicted for killing five members of a family, including a pregnant woman, after accusing two of the victims of adultery (declaring them "Siahkar"). The attackers opened fire on a sleeping household, allegedly to avenge a refused marriage proposal and to seize property. The trial court had sentenced the appellants to death for three of the murders and ordered compensation to the victims' families. The convicts appealed, and while the appeal was pending they reached a compromise with some of the surviving legal heirs, who pardoned them and waived their right to demand retribution (Qisas), asking the court to accept the settlement and acquit the accused.

The High Court refused to accept the compromise. It held that under the law, when a murder is committed in the name of honour—such as "Karo Kari" or similar customs—courts are not bound to allow such settlements, especially when the crime is particularly brutal, cruel, and shocking to society. The judges stressed that killing in the name of family honour or religion cannot be justified or sanctified by law. Because this case involved the slaughter of an entire family while they slept, for no real justification beyond honour and property, the court dismissed the compromise application.

This ruling reaffirms that courts can and should reject private compromises in extremely heinous honour-based killings, prioritizing justice and public interest over family settlements.
