Ghulam Nabi V. The State,
YLR 2020 985 · Balochistan High Court
Ghulam Nabi was convicted by a trial court for killing his daughter, Sehrish, after she and her husband beat the girl with shoes over a dispute involving a mobile charger. The girl died the next day, and the mother, who was the appellant's wife, eventually lodged an FIR after the body was exhumed for a post-mortem. The trial court convicted the father under section 302(c) of the Pakistan Penal Code (qatl-i-amd, intentional murder with lesser punishment) and sentenced him to ten years in prison plus compensation.
On appeal, the Balochistan High Court examined whether the delay in filing the FIR and the fact that the complainant was the accused's own wife should weaken the case. The court held that delay alone does not make an FIR unreliable, especially given the family lived together and the wife observed purdah, explaining her hesitation to report immediately. The court also found no evidence of premeditation or serious enmity between the parties, and noted the weapon used (shoes) and circumstances did not show clear intent to kill.
Based on this, the High Court decided the case did not meet the threshold for murder under section 302(c), but instead fit the lesser offense under section 315/316 PPC (qatl-shibh-i-amd, unintentional killing with harmful intent). The court modified the sentence accordingly, while still dismissing the appeal, meaning the appellant remained convicted, but for a lesser offense reflecting the absence of premeditated intent to kill.
