Mor Khan and another V. The State,
YLR 2020 942 · Balochistan High Court
This case involved two men, Mor Khan and another accused, who were convicted of murdering the complainant's uncle following a shooting on 19 December 2017. The prosecution's case was that the accused, armed with pistols, ambushed the complainant, his uncle, and cousin while they were on their way to irrigate farmland, and opened fire, killing the uncle on the spot. The motive was said to be longstanding enmity between the families. The trial court convicted the accused under section 302(b) of the Pakistan Penal Code and sentenced them to life imprisonment plus compensation to the victim's heirs. They appealed to the Balochistan High Court.
The High Court upheld the conviction. It found the eyewitness testimony of the complainant and his cousin to be consistent, credible, and mutually corroborating, noting that the witnesses knew the accused personally, making misidentification unlikely. The FIR had been lodged promptly, within an hour, undermining any suggestion of fabrication through delay. The court also rejected the defence argument that the witnesses were unreliable simply because they were relatives of the deceased, clarifying that relationship alone does not make a witness "interested" unless there is evidence of bias or motive to falsely implicate someone. Additionally, forensic evidence—recovered pistols and cartridge casings matched by a firearms report—supported the prosecution's case. The appeal was dismissed, reinforcing key principles about evaluating eyewitness credibility and the weight of forensic corroboration in murder trials.
