Director General, Pakistan Coast Guard Head Quarter, Karachi through Deputy Attorney General V. Sikandar,
YLR 2020 731 · Balochistan High Court
This case involved an oil tanker seized after 900 kilograms of charas (hashish) were found hidden in secret compartments during a checkpoint search in 2016. The two men driving the tanker, Sana Ullah and Sajid, were later convicted of narcotics trafficking. Sikandar, who claimed ownership of the tanker, was acquitted in the main case. Since no verdict had been issued regarding what should happen to the tanker itself, Sikandar applied to the trial court for its temporary release (superdari) into his custody, producing valid ownership documents that were verified by the Excise and Taxation Department. The trial court granted his request, and the Pakistan Coast Guard challenged that decision before the Balochistan High Court.
The High Court upheld the release of the vehicle. It explained that under Section 32 of the Control of Narcotic Substances Act, 1997, a vehicle used to transport drugs can only be confiscated if the prosecution proves the owner knew it was being used for that purpose. Here, there was no evidence Sikandar had any knowledge of or connection to the crime, and no one else came forward to claim the tanker. Relying on a Supreme Court precedent with similar facts, the High Court ruled that an innocent owner with valid documents and no link to the offence is entitled to recover his vehicle. The petition was dismissed.
This judgment matters because it clarifies that owners uninvolved in drug trafficking should not automatically lose their property, protecting innocent third parties from unjust confiscation.
