Nasrullah V. The State,

YLR 2020 693 · Balochistan High Court

This case involved Nasrullah, who was convicted by a trial court in Loralai for illegal possession of a pistol under the Arms Ordinance, 1965, and sentenced to two years' imprisonment plus a fine. The pistol had allegedly been recovered based on information he gave during investigation of a separate, unrelated murder case.

Nasrullah appealed to the Balochistan High Court, and the court overturned his conviction, acquitting him. The judges identified several serious flaws in the prosecution's case. First, the pistol was recovered from an open place accessible to the public, not somewhere under Nasrullah's exclusive control, and no independent private witness was present during the recovery—only police officials. Second, the weapon was sent to the forensic laboratory without the spent cartridges (empties), meaning the lab could only confirm the gun was in working condition, not that it was actually used in any crime or exclusively linked to the accused. Third, there was an unexplained two-month delay before the weapon was even sent for forensic testing, and the prosecution never explained who had custody of the weapon during that gap or presented evidence of its safe-keeping.

Given these gaps, the court ruled the evidence was too weak and doubtful to sustain a conviction, and under legal principles requiring recoveries to be free of doubt, the benefit of that doubt had to go to the accused. This case illustrates how Pakistani courts scrutinize the reliability and chain of custody of physical evidence, especially in weapons cases, before allowing a conviction to stand.
