Nasrullah V. The State,

YLR 2020 644 · Balochistan High Court

This case is from the Balochistan High Court, deciding an appeal by Nasrullah, who had been convicted of murdering the complainant's brother during an alleged robbery, along with related charges of attempted murder and causing grievous hurt.

The court found serious problems with the prosecution's evidence. The complainant was not an eyewitness, and the FIR was initially lodged against unknown persons. The accused was only arrested later based on a co-accused's confession in another case, not because he was identified at the scene. The identification parade used to link him to the crime was conducted in a police lockup after a magistrate had refused to hold it due to missing documentation, making it unreliable. The two witnesses who claimed to have seen the incident gave contradictory and inconsistent accounts about basic facts, such as how the body was transported and the exact timeline of events, and their presence at the scene was not confirmed by other evidence like the site plan. There was also an unexplained four-hour delay in filing the FIR, and the medical evidence about the timing of the victim's death did not match the witnesses' testimony.

Given all these inconsistencies and unreliable evidence, the court ruled that the prosecution failed to prove its case beyond reasonable doubt. The appeal was allowed, and Nasrullah's conviction and sentence were set aside, resulting in his acquittal. This case highlights how flawed identification procedures and contradictory witness testimony can undermine a criminal conviction.
