YLR 2020 602 · Balochistan High Court
This case is about a land dispute in Quetta. The buyers, Muhammad Ramzan and another person, claimed they had agreed to purchase a portion of land from a seller in 2006 through a sale agreement, paying earnest money, with the balance to be paid in installments. They alleged the seller later secretly sold the same land to other people through official mutation entries, so they sued for specific performance of the contract, cancellation of those mutation entries, and a permanent injunction. The trial court dismissed their suit, and they appealed.
The Balochistan High Court upheld the dismissal. It found that the buyers failed to properly prove their case: their witnesses gave no clear evidence about the sale price or date, only one witness to the agreement was produced instead of the legally required two marginal witnesses, and the sale consideration payment was not proven. The court also noted that such agreements involving property over Rs.100 need registration, that merely signing an agreement to sell does not create ownership rights, and that the buyers never deposited the remaining sale price with the court, which is required when seeking enforcement of such an agreement.
This ruling matters because it reinforces that courts require solid, consistent proof and proper legal procedure before enforcing property sale agreements, and clarifies that an unregistered agreement to sell does not by itself grant ownership or legal rights over land.
