YLR 2020 44 · Balochistan High Court
This case is about a dispute between neighbours or business parties that turned into a criminal complaint. Khan Muhammad claimed he had leased a property for a car-parking business, and alleged that the petitioners, along with 20 to 22 armed men, forcibly entered the premises, broke locks, and stole valuable items. He asked the Additional Sessions Judge, acting as Justice of Peace, to order police to register a criminal case (FIR) against the petitioners. The Justice of Peace granted this request, and the accused challenged that order before the Balochistan High Court.
The High Court set aside the order directing FIR registration. It found the complaint doubtful because it did not mention a date for the alleged incident or name any witnesses. The police report itself confirmed that the dispute was essentially civil, over property, and that a civil suit was already pending between the parties. The court also noted that the petitioners were not given a chance to be heard before the order was passed, and found signs that the complaint may have been filed in bad faith to pressure the other side in the ongoing civil litigation.
The judgment clarifies that a Justice of Peace must not act as a rubber stamp when deciding whether to order registration of an FIR. They must independently verify that there is genuine supporting material, especially in cases that appear to stem from civil disputes, and should ideally hear the accused unless there's urgency or risk of evidence being destroyed. This protects people from criminal cases being misused as tools in civil disputes.
