Waqas Ahmed V. Arshad Mehmood and 2 others,

YLR 2020 437 · Balochistan High Court

This case is about a criminal appeal against acquittal decided by the Balochistan High Court. Waqas Ahmed had accused Arshad Mehmood and others of murdering his brother, Waqar Ahmed, in an armed ambush. According to the complaint, six men on motorcycles stopped the family's vehicle, dragged the brother out, and shot him on the instructions of one of the accused. A trial court had already acquitted the accused under a legal provision allowing early acquittal when the evidence is weak, and the complainant appealed against that decision.

The High Court upheld the acquittal. It found serious problems with the prosecution's case: the FIR was filed seven hours after the incident without a good explanation, raising suspicion that the complainant may have consulted others before naming suspects. The complainant's story that he walked to the police station despite having a vehicle available also seemed implausible. Additionally, the key eyewitness failed to identify the accused in court, no identification parade was conducted, and physical evidence like bullet casings and blood-stained soil was collected fourteen days late. The witnesses were also close relatives of the victim, raising questions about bias.

The court explained that once someone is acquitted, they gain a "double presumption of innocence," meaning strong evidence is needed to reverse that finding on appeal. Since the trial court's reasoning was sound and not based on any misreading of evidence, the High Court dismissed the appeal, confirming the acquittal of the accused.
