Ali Akbar V. Mst. Samina and another,

YLR 2020 332 · Balochistan High Court

This case involved a husband and wife whose marriage lasted only seven months before breaking down. The wife filed a suit in the Family Court seeking dissolution of marriage, return of her dowry articles (or their value), and unpaid maintenance, alleging that her husband and his family mistreated her, that he was a drug addict who tortured her while intoxicated, and that she was eventually thrown out of the house. The husband contested the case, but the Family Court ruled in the wife's favor, granting dissolution of marriage and ordering return of dowry articles and maintenance. The husband challenged this decision before the Balochistan High Court, arguing the trial court had ignored evidence and wrongly accepted the wife's claim of cruelty.

The High Court dismissed the husband's petition. It held that the trial court was right to dissolve the marriage since genuine hatred had developed in the wife's mind, which is a valid ground for such relief, and courts must assess this based on the facts of each case. On the dowry issue, the husband's own witnesses admitted the wife had brought the articles, shifting the burden to him to prove otherwise, which he failed to do. The court noted that in practice, brides are rarely able to keep receipts or signed lists of dowry items. This case matters because it reinforces that courts can rely on the overall circumstances and testimony, rather than strict documentary proof, when deciding dowry and divorce disputes.
