Attaullah V. The State,
YLR 2020 315 · Balochistan High Court
This case involved a bail application filed by Attaullah, who was arrested and charged under the Control of Narcotic Substances Act, 1997, after five kilograms of narcotics were allegedly recovered from his possession during a routine check of a passenger coach by Coast Guard personnel in Uthal, Balochistan.
Attaullah's lawyer argued for bail on the grounds that the investigation had dragged on for over six months without witness statements being recorded, that no independent or public witness was present during the search, and that the challan (charge sheet) had already been submitted, meaning the accused was no longer needed for further investigation.
The Balochistan High Court rejected these arguments. It held that the requirement under Section 103 of the Criminal Procedure Code for independent witnesses during a search does not apply to narcotics cases, since this requirement is specifically excluded by Section 25 of the CNS Act. The court also noted that law enforcement officers are considered credible witnesses unless the accused can show bias or ill will, which was not demonstrated here. Since the offence carried a punishment of life imprisonment or death, it fell under the category of serious offences where bail is generally restricted under Section 497 of the CrPC. The court further explained that bail should not normally be granted at the early stage of a trial when evidence is still being presented.
This judgment reinforces how Pakistani courts treat narcotics cases seriously, limiting bail where large quantities of drugs are involved and the recovery process appears procedurally sound.
