Mir Hussain V. The State,
YLR 2020 2514 · Balochistan High Court
This case is about a murder appeal before the Balochistan High Court. The accused, Mir Hassan, had been convicted of killing the complainant's cousin by firing, along with a co-accused, and was appealing that conviction.
The High Court overturned the conviction and acquitted the appellant, giving him the benefit of the doubt. The judges found serious problems with the prosecution's evidence. The eyewitnesses' presence at the crime scene was questionable, since the medical officer said the victim was brought to hospital by twenty unnamed members of the public, not by the complainant or witnesses as claimed. There was also an unexplained two-hour delay in filing the police report, despite the victim dying within minutes and the police station being only six kilometers away, suggesting the complaint may have been crafted after deliberation. Additionally, a key witness's statement was recorded two days late with no explanation, and the prosecution failed to produce the pickup driver who allegedly witnessed the event and drove the victim to hospital, nor did police interview the twenty people who accompanied him.
The court also noted it was implausible that armed attackers firing repeatedly from close range would hit only the victim while sparing nearby witnesses who could identify them.
This case matters because it illustrates how Pakistani courts scrutinize delays in reporting crimes, inconsistencies in witness testimony, and missing evidence to prevent wrongful convictions based on unreliable evidence.
