YLR 2020 2498 · Balochistan High Court

This case involved a long-running landlord-tenant dispute in Balochistan. The landlords had won an eviction order against the tenants back in 2009 from the District Judge, Pishin. The tenants challenged this decision through a revision petition in the High Court and then the Supreme Court, but both were dismissed, with the Supreme Court finally rejecting the case in January 2018.

The landlords then filed an execution petition in October 2018 to enforce the 2009 eviction decree. The tenants objected, arguing that too much time had passed and the execution request was barred by limitation law, which generally requires such petitions to be filed within three years of a decree. The lower courts rejected this objection, reasoning that the pending appeals had effectively kept the matter alive.

The High Court disagreed. It held that simply appealing or filing a revision petition does not automatically pause or stay a judgment unless a court specifically grants a stay order, which had not happened here. Since no such stay existed, the three-year clock started running from 2009, meaning the execution petition filed in 2018 was nine years late and time-barred. The court also rejected the landlords' excuse that they mistakenly believed pending appeals blocked execution, stating that ignorance of the law is not a valid excuse.

As a result, the High Court overturned the lower courts' rulings and dismissed the execution petition entirely, ruling in favor of the tenants on procedural grounds. This case reinforces the importance of timely legal action and clarifies that appeals do not automatically freeze enforcement deadlines.
