Asmatullah V. The State,

YLR 2020 2336 · Balochistan High Court

The case involved Asmatullah, who was convicted by a trial court for the murder of Munir Ahmed and the attempted murder of his companion, following an altercation stemming from a prior dispute between the complainant's brothers and the accused's father. The trial court sentenced him to death, along with fine and compensation, and also convicted him under Section 324 PPC for attempted murder.

On appeal, the Balochistan High Court examined the evidence closely. It found that none of the prosecution's witnesses, including the complainant, actually saw the accused at the scene. The key evidence was a statement given by the injured eyewitness, Syed Tawab Shah, but this was recorded earlier under Section 512 Cr.P.C. during proceedings against a co-accused, without the appellant present or able to cross-examine him. Before the fresh trial could properly record his testimony, the witness died in an unrelated road accident, and the trial court simply relied on his old, untested statement to convict Asmatullah.

The High Court held that such an uncross-examined statement could not be used against the appellant, and that the remaining witnesses were closely related to the deceased, requiring cautious scrutiny. With no weapon recovery, no independently proven motive, and no corroborating evidence, the prosecution failed to prove guilt beyond doubt. The Court acquitted Asmatullah, highlighting the importance of reliable, tested evidence before convicting someone of murder.
