Fazal Ur Rehman V. Government of Balochistan through Secretary Home and Tribal Affairs and 2 others,

YLR 2020 2232 · Balochistan High Court

This case is about a citizen challenging the government's decision to list his name as a "proscribed person" under anti-terrorism law. Fazal Ur Rehman had been arrested in connection with several FIRs (police cases) in Quetta but was granted bail and later acquitted by the courts. Despite this, the Balochistan government placed his name in the Fourth Schedule of the Anti-Terrorism Act, 1997, a list reserved for people suspected of terrorism-related activities, first in 2015 and again in 2019. He petitioned the Balochistan High Court to have his name removed.

The police officer investigating his case reported that Rehman was not involved in any anti-state activities and was not a member of any banned organization. Based on this, the court found that the government had added his name without proper evidence or valid reasons. It held that merely being named in criminal cases is not sufficient grounds to restrict someone's liberty, and that Article 4 of the Constitution guarantees every citizen the right to be treated according to law. Keeping someone on such a list indefinitely without justification violates this fundamental right.

The court allowed the petition and ordered authorities to remove Rehman's name from the Fourth Schedule. The judgment matters because it reinforces that the state cannot restrict citizens' liberty through terrorism-related blacklists without solid evidence, protecting individuals from indefinite, unjustified restrictions.
