Asadullah alias Sado V. The State,

YLR 2020 2210 · Balochistan High Court

This case is about a shooting in Quetta in 2009 in which a man, Asadullah alias Sado, was accused of killing four members of one family, his father, uncle, and two cousins, and injuring a labourer, allegedly over a previous enmity between the families. The trial court had convicted him of murder and sentenced him to death, along with additional punishments for attempted murder and causing injury, and referred the death sentence to the High Court for confirmation.

On appeal, the Balochistan High Court examined the evidence carefully. Four eyewitnesses, including the complainant, gave consistent accounts naming Asadullah as the person who fired the shots, and their testimony was supported by medical evidence. The court held that being relatives of the deceased did not make these witnesses unreliable, since their presence at the scene was natural, and that even weak motive evidence does not undermine a strong eyewitness case.

However, the injured labourer who survived the attack never testified, and no proof was given for why he was unavailable, such as a death certificate. Because his own account of his injuries was missing, the court set aside the conviction and sentence specifically related to injuring him, while upholding the murder conviction and death sentence.

This case matters because it shows how courts weigh eyewitness testimony, medical evidence, and gaps in the prosecution's case to ensure convictions meet the standard of proof beyond reasonable doubt.
