Abdul Hadi V. The State,
YLR 2020 2161 · Balochistan High Court
This case involved Abdul Hadi, who was stopped while driving a vehicle near Killa Saifullah after police received a tip-off about charas being smuggled from Quetta to Loralai. A search revealed ten kilograms of charas hidden beneath the driver's seat mat. He was tried and convicted under section 9(c) of the Control of Narcotic Substances Act, 1997, and sentenced to life imprisonment with a fine.
On appeal, his lawyers argued the case was fabricated, that no independent witnesses (as required under section 103 of the Criminal Procedure Code) were present during the search, and that there were delays and irregularities in sending drug samples for chemical testing.
The Balochistan High Court rejected these arguments. It held that section 25 of the Narcotics Act specifically excludes the requirement for private witnesses in such searches, so their absence did not invalidate the case. The court also found no evidence of enmity between police witnesses and the accused, and confirmed the samples reached the laboratory within the permissible 72-hour window, with proper testing confirming the substance was charas. The court reaffirmed that a driver is legally responsible for narcotics found in the vehicle he is driving.
However, since the quantity (10 kg) did not meet the higher threshold requiring mandatory life imprisonment under the law's proviso, the court reduced his sentence while upholding the conviction. The appeal was otherwise dismissed. This case clarifies how courts treat police-only searches in narcotics cases and how sentencing depends
