Fayyaz Ahmed and 2 others V. Muhammad Azam,

YLR 2020 1764 · Balochistan High Court

This case involved a landlord-tenant dispute over half a house in Quetta. The landlord, Muhammad Azam, sought to evict tenants (the Fayyaz Ahmed family) for non-payment of rent since January 2014 and because he needed the property for his own personal use. The tenants denied that any landlord-tenant relationship existed, arguing there was no written rental agreement and no rent receipts proving they paid rent to the landlord.

The Rent Controller originally ruled in favor of the landlord, ordering the tenants to vacate and pay back rent. The tenants appealed to the Balochistan High Court.

The High Court upheld the eviction order. It found that the landlord had proven ownership of the property through mutation (land record) entries and utility bills, while the tenants could not produce any document proving their own right to possess the premises. The court held that a tenancy does not need to be in writing - it can be oral or implied through conduct, especially where parties are closely related, as was claimed here. Since the landlord's ownership was unchallenged by any proof from the tenants, the law presumes the person in possession is a tenant. The court also found the tenants had deliberately avoided paying rent.

This judgment matters because it confirms that Rent Controllers can decide landlord-tenant relationships based on circumstantial evidence like ownership records, and that oral tenancies are legally valid even without formal written agreements.
