Ghulam Nabi V. Mir Muhammad Ali Rind,
YLR 2020 172 · Balochistan High Court
This case concerns a lawsuit for 250 million rupees in damages, filed by Mir Muhammad Ali Rind against Ghulam Nabi over alleged false accusations of corruption and running terrorist camps. During the proceedings, Ghulam Nabi stopped appearing in court. After repeated failed attempts at notifying him through ordinary means, the trial court ordered notice by newspaper publication (substituted service). However, the publication was submitted late and did not correspond to the actual hearing date on which Ghulam Nabi was ultimately declared absent (ex-parte). The court then decided the case against him and awarded damages without his participation.
Ghulam Nabi later asked the trial court to set aside this ex-parte decree, arguing he was never properly informed of the case. The trial court refused, and he appealed to the Balochistan High Court.
The High Court found that the trial court had not followed the proper legal procedure for substituted service, such as pasting notice at his home or business, or confirming through a process server that ordinary summons had failed. It also found that he was declared ex-parte on a date for which no valid publication existed. The High Court held this was a serious legal error and ruled that cases should be decided on their merits, not technical shortcuts. It allowed the appeal, effectively giving Ghulam Nabi a chance to defend the case properly.
