Ahmed Shah and another V. The State,

YLR 2020 1715 · Balochistan High Court

This case is about two men, Ahmed Shah and Abdul Wali, convicted by an Anti-Terrorism Court in Loralai for possessing explosive substances found in a vehicle they were traveling in. They were sentenced to five years in prison. They appealed to the Balochistan High Court.

The High Court overturned the conviction and acquitted both men. The judges found serious flaws in how the case was investigated and prosecuted. First, the police officer who filed the complaint also conducted the entire investigation himself, which raised concerns about bias, especially since he was of a rank (Assistant Sub-Inspector) below what the law requires for investigating such offenses under the Anti-Terrorism Act. Second, instead of calling independent, respectable witnesses from the area to observe the search and recovery of evidence, as required by law, the officer chose only his own subordinates as witnesses. Third, the prosecution failed to prove the evidence had been safely stored or properly handled after recovery. Fourth, the report identifying the seized material as explosives came from someone not officially recognized as an expert by the government, making it legally inadmissible. Finally, there was no proof that one of the appellants was even aware of the explosives hidden in the vehicle's trunk.

Because of these serious lapses, the prosecution failed to prove guilt beyond reasonable doubt. This case highlights the importance of independent witnesses, unbiased investigation, and proper evidence-handling procedures in criminal trials, especially in serious cases involving explosives and terrorism charges
