Muhammad Yousaf V. The State,
YLR 2020 1423 · Balochistan High Court
This case is about a fatal shooting on a road near Mastung. The complainant, Nazar Muhammad, and his nephew were riding a motorcycle when the appellant, Muhammad Yousaf, along with another man, intercepted them and opened fire. The nephew died at the scene, and the complainant himself was wounded. A trial court convicted Yousaf of murder, attempted murder, and causing injury, sentencing him to life imprisonment plus additional jail terms and fines. He appealed to the Balochistan High Court, arguing mainly that the FIR (police report) had been filed a day late, which he claimed cast doubt on the prosecution's story.
The High Court rejected this argument, finding that the delay was caused by police procedure (officers first took the injured complainant to hospital) rather than any attempt to falsely implicate the accused. The court emphasized that the complainant was an injured eyewitness with no prior enmity against the accused, that his account was consistent and detailed, and that medical evidence supported his version of events. The judges reiterated established legal principles: a solitary witness's testimony can be enough for conviction if credible; relationship to the victim doesn't automatically discredit a witness; and delay in filing an FIR alone is not grounds to disbelieve a case.
Finding the prosecution's evidence reliable and well-corroborated, the court dismissed the appeal and upheld the conviction and sentence. The case illustrates how courts evaluate witness credibility and procedural delays in serious criminal cases.
