Abdul Nafey V. The State,

YLR 2020 1311 · Balochistan High Court

This case involved Abdul Nafey, who was convicted of murdering a man named Jelani after an argument outside Jelani's house. According to the prosecution, the accused was standing in front of the victim's home, and when challenged by the deceased, he pulled out a pistol and shot him. The trial court in Pishin convicted the appellant of murder under the Pakistan Penal Code, sentencing him to life imprisonment and ordering him to pay compensation to the victim's family. He appealed to the Balochistan High Court, though the appeal was filed five months late.

The High Court examined the evidence, which relied mainly on one eyewitness (the deceased's brother) whose account matched the FIR, filed promptly after the incident, and was consistent with the medical evidence showing a fatal gunshot wound. The court held that a single eyewitness's testimony can be enough to convict if it is credible and consistent, since what matters is the quality of evidence, not the number of witnesses. It also ruled that being related to the victim does not automatically make a witness unreliable, especially when there's no evidence of enmity toward the accused that would motivate false testimony. The court further noted that absence or weakness of a motive doesn't matter when strong direct and medical evidence proves the crime.

Finding the prosecution's case solid and well-corroborated, the High Court dismissed the appeal and upheld the conviction and sentence. The case reinforces important principles about evaluating eyewitness credibility in murder trials.
