YLR 2020 1077 · Balochistan High Court
This case is about a criminal shooting incident from 2010 in Quetta, in which three unidentified men on a motorcycle allegedly opened fire, and later the complainant added a supplementary statement claiming additional attackers arrived in a Prado vehicle, naming several people including one respondent. That respondent was not named in the original FIR but was implicated later through this improved version of events. He surrendered before the Anti-Terrorism Court and was granted pre-arrest bail, which was later confirmed by the trial court.
The complainant then asked the Balochistan High Court to cancel this bail, arguing the respondent had been absconding for a long time and that the trial court had wrongly exercised its discretion in granting bail.
The High Court rejected this request and upheld the bail. It found no evidence that the respondent even knew he had been implicated, since he was named only in a later supplementary statement rather than the original FIR. The court held that such circumstances fall within the scope of "further inquiry," which can justify granting or confirming pre-arrest bail. It also noted there was no sworn evidence (affidavit) showing the respondent had misused his bail.
This decision matters because it reaffirms that bail decisions depend on the specific facts of each case, and that late, unsupported implication of an accused through a subsequent statement can be legitimate grounds for courts to grant or maintain bail rather than automatically canceling it.
