Abdul Qudoos V. The State,

YLR 2019 2907 · Balochistan High Court

This case involved Abdul Qudoos, who was convicted by a Special Judge in Dalbandin under the Control of Narcotic Substances Act, 1997, for allegedly possessing 38 packets of charas found during a police raid on a house. He was sentenced to life imprisonment and a fine.

On appeal, the Balochistan High Court overturned the conviction and acquitted him. The court found several serious problems with the prosecution's case. First, the police never actually proved that the house where the drugs were found belonged to or was controlled by the accused—no documents, land records, or neighbor testimony were presented to establish this, and witnesses admitted other people also lived there. Since mere recovery from a house doesn't prove guilt unless ownership and conscious possession are established with solid evidence, this gap was fatal to the case.

Second, the drug samples were sent for chemical testing 35 days after seizure, an unexplained and unusual delay that raised doubts about whether the samples were properly stored and safely transported to the laboratory. The court relied on Supreme Court precedent holding that when safe custody and transmission aren't proven, lab reports become unreliable. Additionally, the laboratory report itself lacked complete testing protocols required by law.

This case highlights how narcotics convictions require the prosecution to prove not just recovery of drugs, but also possession, ownership, and proper handling of evidence—procedural shortcuts can result in acquittal even in serious drug cases.
