Muhammad Ismail Khan V. Yar Muhammad and 3 others,
YLR 2019 2843 · Balochistan High Court
This case is about a criminal appeal filed by a father after the men accused of beating his son were acquitted by a trial court in Kharan, Balochistan.
Muhammad Ismail Khan's son, Noor Ahmed, was allegedly attacked and beaten by Yar Muhammad and two others while performing ablution near a tank. The father lodged an FIR, and the accused were tried for causing hurt under sections of the Pakistan Penal Code. After hearing eight prosecution witnesses, the trial court acquitted all three accused. The father then filed an appeal against this acquittal under Section 417(2-A) of the Criminal Procedure Code, which allows a "person aggrieved" to appeal an acquittal.
The Balochistan High Court did not examine the merits of the beating allegations at all. Instead, it focused on a threshold legal question: was the father legally entitled to file this appeal? The court held that "person aggrieved" in hurt cases means the actual victim who suffered the injury, not just any relative or family member. Since the father was not present at the scene, was not himself beaten, abused or threatened, and only learned of the incident afterward, he did not qualify as an aggrieved person under the law. The court distinguished murder cases, where legal heirs of a deceased victim can pursue appeals, from hurt cases, where only the injured person themselves generally has that right. As a result, the appeal was dismissed as not maintainable, without any ruling on whether the accused were actually guilty.
