Atta Muhammad V. Aurangzaib and 2 others,

YLR 2019 2488 · Balochistan High Court

This case involved an appeal against the acquittal of two men accused of murdering a young man named Muhammad Rafique. The victim's father, who was the complainant, alleged that during a quarrel between his neighbors and his brother-in-law, the accused held him and his brother-in-law down while another person (not one of the two respondents) stabbed his son to death. The father challenged the trial court's decision to acquit the two respondents, arguing the evidence against them was strong and had been wrongly dismissed.

The Balochistan High Court disagreed with the appellant and upheld the acquittal. It found that none of the prosecution's eyewitnesses had accused the two respondents of actually inflicting any injury, and all witnesses agreed the respondents were unarmed at the time. The court also noted that all the eyewitnesses were close relatives of the complainant, even though independent bystanders were reportedly present, raising doubts about the reliability of the testimony. Mere presence at the scene, the court held, does not prove participation in a crime, and there was no solid evidence that the respondents shared a common intention to kill.

The judgment reinforces an important legal principle: when a person is acquitted by a trial court, that acquittal carries a strong presumption of innocence that appellate courts should not overturn unless the original decision was clearly unreasonable or unsupported by evidence. Here, the High Court found the trial court's reasoning sound and dismissed the appeal.
