Abdullah Khan V. Ghulam Jan and 2 others,

YLR 2019 2374 · Balochistan High Court

This case involved a father, Abdullah Khan, whose son Sajid Ali was found murdered in Quetta in 2014. He accused several relatives, with whom his family had a prior dispute over relationships, of killing his son. After years of investigation, these accused persons were arrested in May 2019 and granted bail by the trial court. The father then approached the Balochistan High Court asking for that bail to be cancelled.

The High Court refused to cancel the bail. It noted that no one had actually witnessed the murder, the accused were implicated purely on suspicion and past enmity, and no weapon or other evidence had been recovered from them. On a preliminary assessment, the case appeared to need further inquiry, meaning the evidence wasn't strong enough to clearly connect the accused to the crime. The court also held that proving motive is the prosecution's job, not something the accused must disprove, and that simply having evaded arrest for years doesn't by itself prove guilt.

The judgment is useful because it lays out the specific, limited grounds on which bail can be cancelled, such as misuse of bail, threatening witnesses, or an arbitrary bail order, and clarifies that these grounds are different and more demanding than the grounds needed to deny bail in the first place. Since none of those grounds were shown here, the request to cancel bail was dismissed.
